Is what I found baby oak leaves or a weed?

I dug up some leaves that appeared to be just opening in spring in Northeast i. Is it really the start of a young oak or a weed?It was in my flower garden.

Oak comes up with three leaves and an acorn on the bottom.  Just dig down up to 6" and check the stem to the acorn.  Firm up the dirt if you want it there, if not dig it out and transplant or toss.

They grow big & mightly, keep it 50 or more feet from any building, wall, septic system drain field, pipes or foundations.
